Artists, Purchasers and Management acting on behalf of Purchasers agree to a standard agency 24 month book-back agreement for all venues and dates. Purchasers must provide a minimum 45 days notice for any cancellation or alterations to the calendars on the following pages. Artists agree to refer all contacts and inquiries that arise from engagements booked on www.scarcellicalendar.com directly and immediately to Agent. . Dueling Piano Entertainers are not to secure air travel more than 42 days in advance. Dueling Piano Players will be paid via ACH. ACH payments are pushed on the first TH after payment has been received by the Purchaser. Artists execute this Agreement as an independent contractor, not as an employee of the Purchaser, and hereby represent the authority to bind and contract said group. Responsibility for appropriate payment of payroll taxes and charges under applicable federal and local law will be assumed by leader. The leader/each individual member is solely responsible for any injuries, accidents or damage claims which may occur in connection with this engagement and hereby holds Lorio-Ross Sterling Entertainment and any employee/independent contractors thereof harmless for any and all damages, and/or legal expenses for any accident, injury lawsuits and/or claims for damages of any kind, including but not limited to non-performance of this Contract. In the event performers are a group, all members designate one member as leader for collection of all funds for the purposes of execution of the agreement. In such event, each group member agrees to take complete responsibility for paying the appropriate federal and state taxes as an independent contractor reporting such sum to the IRS on form 1099. Should any Purchaser cancel any ongoing agreement for any venue on this calendar system, any artist who has confirmed dates on www.scarcellicalendar.com is exempt from working at said venue without receiving pay directly from Lorio Ross, in the form of a check, issued by Lorio Ross, for a period of 24 months from the time the Purchaser cancelled the ongoing agreement.

Artist agrees check site on a bi -weekly basis for updates, information and newsletters. Artist agrees to log on and confirm any future bookings within 48 hours of notification by agency. Checks are mailed by Friday following the engagement or in some cases checks are mailed only after Agent has received payment from Purchaser. Artist understands that if bookings are not confirmed within 48 hours after contacted by agency, the booking at hand may be cancelled. Purchaser accepts www.scarcellicalendar.com as a continuation of any verbal and/or written agreements. All Dueling Piano purchasers must provide a minumum of 45 days notice for cancellations, adjustments or discontinuation. All Dueling Piano artists agree to work only with Dueling Piano players scheduled and paid by Dueling Pianos International for venues listed in this calendar system and are prohibited from performing with any artists that are not booked and paid by Dueling Pianos International. Any promotional companies, promotors or agents other than a Dueling Pianos International agent that are involved, in any way, shape or form, with the booking of any acts on the following pages are considered a direct resource of Dueling Pianos International and are exempt from booking entertainment in the respective venues without written consent from Dueling Pianos International. In the event leader, key personnel, their company, corporation, partnership (or any part thereof) are re-booked by the Purchaser into any establishment owned or controlled by the Purchaser, or by contacts from the Purchaser within 24 months of termination of the booking Agreement between the Purchaser and Agency, Artist, Leader and Purchaser agree to be jointly and severally liable for payment of commission to Agency at the same rate as provided under the Agency/Artist course of conduct throughout their working relationship, and any related confirmation, or contracts, payroll and other records.Commencement of engagement together with physical delivery of this Contract is deemed to be a verification of an oral agreement and acceptance of all terms by all parties. This contract constitutes the entire agreement between the parties and may not be modified, amended and/or cancelled except in writing, signed by both parties. If any of the provisions of this Agreement are determined to be void or unenforceable, the remaining provisions hereof shall remain in full force.
